When we refer to "YOUR NATURAL BEAUTY", "we", "us", or "our", we mean YNB, Lda. When we refer to "you", "your", and "yours", we refer to you, the person using the Services.
We use headings to help you understand these Terms and Conditions and to locate information more easily. These Terms and Conditions are available only in the Portuguese language. We will not send copies of the contracts entered into between us and the entities supplying the products, or between you and the Partners related to the sale of the products, so we recommend that you print or save a copy of these Terms and Conditions for your records (however, please note that we may change these Terms and Conditions whenever we deem it relevant, so we advise you to check these Terms and Conditions whenever you use the Services to request products, to ensure that you understand the legal terms that apply at that time).
We are Your New Brand, Lda, and we operate the website. Your New Brand, Lda is a company registered in Portugal, and our headquarters are located at Rua 13 de Maio, nº 1297, 4800-530 Guimarães. Our registration and tax identification number is 516 129 554.
We provide the services through the website. More details about the services we provide are set out in section 3 below. When you purchase products using the website, you are purchasing them from manufacturers and creators ("Partner(s)") indicated on the website. It is important to understand that the contract for the purchase and sale of the products is between you and the Partner. We are acting as an agent/intermediary of the Partners. Therefore, you are not buying the products from us, but from our Partners. We are authorized by the Partners to conclude the contract on your behalf, but we are not a party to that contract.
The services we offer allow you to browse the website and purchase products from partner brands. As part of the Services, we also provide some auxiliary services, such as arranging product delivery and providing customer support assistance. However, as previously mentioned, the contract for the purchase and sale of products is entered into between you and the Partner. This means that the Partner (not us) is legally responsible for selling you the products.
Please note that the delivery logistics service is provided by us to you, and as such, you are entering into a contract with us for product delivery services on behalf of the Partners. This delivery service may have costs, which will be displayed at the checkout and before purchasing the products.
To use the Services, you must be over 18 years of age.
In the event of our breach of the Terms and Conditions, we shall be liable for losses or damages that are a foreseeable result of such breach of these Terms and Conditions. However, we are not liable for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it is an obvious consequence of our breach or if it was contemplated by you and us at the time you started using the Services. We do not exclude or limit in any way our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) any other liability that cannot be limited by law.
We strive to be as accurate as possible in the description of the products displayed on the website. However, since the descriptions are based on information provided by the Partners (who are solely responsible for such information), we cannot guarantee that all details are always accurate, complete, or error-free. Please contact our customer service if you wish to obtain more information about a specific product. The product images on the website are for illustrative purposes only, and while we attempt to display colors accurately, we cannot guarantee that the image display on your computer accurately reflects the true color of the products.
We do not allow Partners to offer defective or substandard products below corresponding market standards for sale on the Site. If a product you requested does not match the description, is defective, or of substandard quality, you can return it to us, and in that case, we will contact the Partner to process the return. Once the product is received by the Partner, after an agreement with us, you will receive a full refund of the price paid for the defective product or, alternatively, a discount, replacement, or repair of the product if possible. We will refund any applicable delivery expenses and reasonable costs incurred in returning the products (we will inform you if the products will be collected directly from the delivery location or if you need to arrange for their return).

As a consumer, you have legal rights concerning defective or non-conforming products. Information about your legal rights is available at: [link to legal rights page]. Nothing in these Terms and Conditions will affect those legal rights.
The products sold by the Partners are intended for domestic and private use only. The consumer will have to agree not to use the products for commercial or resale purposes. You also agree not to export or otherwise transfer the products to countries or territories subject to comprehensive embargoes or sanctions or to individuals identified on the U.S. Department of the Treasury's Office of Foreign Assets Control Specially Designated Nationals and Blocked Persons List, which can be found at: [link to list] or the EU Consolidated List of Financial Sanctions, which can be found at: [link to EU list].
Neither we nor the partners have any liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
Your Natural Beauty guarantees that the beauty products displayed on the website do not contain components that could pose risks to health or the environment.
As explained above, the contract for the purchase and sale of products is entered into between you and the Partner producer/manufacturer of the purchased product. We act as agents/intermediaries and are authorized by the Partner to conclude the contract with you on their behalf, but we are not a party to that contract, and you are not purchasing the products directly from us or through us acting as your agent.
Under the contract we enter into with the Partners, they are obligated to have and maintain reasonable business policies that comply with our own business policies. However, we cannot be responsible for the business policies of the Partners. If you are not satisfied with the product or service you received from a partner, you should contact us; Your Natural Beauty will promptly get in touch with the selected partner to try to resolve the issue.

By completing the checkout process and placing an order by clicking the "Proceed to Checkout" button on the checkout page, you are agreeing to purchase the products from the Partner that you have selected. Your order for the products is subject to these Terms and Conditions, which are incorporated into the contract between you and the selected Partner. All orders are subject to availability and confirmation of payment of the order price.
The order may be fully or partially canceled if the product is not available or not available at the order price determined by the selected Partner.
After entering into the purchase and sale contract for the products with the Partner, they are legally obligated to provide goods that are in compliance with the contract. Ownership of the purchased product will be transferred to you immediately upon acceptance of payment and confirmation that the order will not be canceled. Any risk related to the product you purchased is borne by the Partner and/or Your Natural Beauty (as applicable) until it is delivered to the address you provided in the order.
To request products, you must be over 18 years old and possess a valid credit or debit card (refer to section (c) below for details on acceptable payment methods). By placing an order, you are ensuring that all provided details are true and accurate, specifically that you are over 18 years of age, an authorized user of the credit or debit card used to place the order, and have sufficient balance in the account to pay for the order price.
The website allows you to review your order and correct any errors before completing a purchase. We advise you to take the time to read and verify your order on each page of the ordering process, as you are responsible for ensuring the provided information is accurate (e.g., correct products, quantities, size, color, etc.).
(a) Formation of the Contract between You and the Partner(s)
The identity of the Partner is displayed on the order confirmation page.
When placing an order, you will receive an email confirming the receipt and acceptance of your order. The contract between you and the Partner is formalized when we send this confirmation email.
All orders are subject to availability and confirmation of payment of the order price, and may be fully or partially canceled if the product is not available or not available at the order price.
The confirmation email will include a description of the products acquired in the order and some other information about your rights to cancel the contract between you and the Partner (see section 10 below for more information on your cancellation rights).
(b) Price, Availability, and Taxes
Your Natural Beauty will make all efforts to ensure that all details, descriptions, and prices appearing on the Site are accurate; however, since this information is provided by Partners, errors may occur.
In the event of an error in the price of any product you requested, Your Natural Beauty will inform you as soon as possible and, acting on behalf of the Partner, you will be given the option to reconfirm your order with the correct price or cancel it. If we cannot contact you, your order will be considered canceled. If you cancel and have already paid for the products, you will receive a full refund as soon as possible.
Depending on your delivery address, different taxation rules and additional charges may apply.
If you receive products from a Partner outside your territory, you may need to pay import/customs duties/taxes upon receiving the products. We will inform you during the checkout process if import duties are included or if you need to pay them upon receiving the products.
If they are not included, meaning you have to pay import duties, neither Your Natural Beauty nor the Partner have control over these fees/taxes and we cannot provide information about their amount.
The Customer is solely responsible for paying any non-included import fees and taxes.
Contact your country's Customs for more information and to obtain an "estimated final cost" before placing your order.

Note that if you return a product, import duties and taxes will be refunded to you if they were originally included in the purchase price. If they were not included, you are responsible for recovering the taxes directly from your country's Customs.

When you submit your order, Your Natural Beauty performs a standard pre-authorization check on your payment card on behalf of the relevant Partner, and products will not be dispatched until the provided details are verified. For information on when your payment will be debited from your account, refer to the "When Will My Payment Be Charged?" section in our FAQs.
YNB, Lda will provide Payment Processing Services.
In the unlikely event that Your Natural Beauty or the Partner encounters an issue processing your order, we will contact you and may request further information to try to resolve the problem.
We reserve the right not to send your order to the Partner, and the Partner reserves the right not to accept your order if, for example, the requested product is out of stock, discontinued, unavailable, or if we do not receive authorization for your payment or you do not meet eligibility criteria (e.g., you are under 18 years old).
The estimated delivery date for the products will be indicated in your order confirmation email. If you do not receive an estimated delivery date, the general rule is that the order will be delivered within 30 days after the shipping date (or confirmation email date), except for custom or ordered products
Your Natural Beauty (and not the Partners) provides delivery services and will make all reasonable efforts to ensure your order is delivered by the estimated delivery date, if provided; however, there may be circumstances where delivery is delayed due to events beyond our reasonable control (please refer to section 15 below for more information). In this case, we will try to arrange delivery of your products as soon as possible, but we will not be liable for any losses caused by such delay.
Delivery times may vary depending on product availability and your delivery address.
Delivery times are estimates only and cannot be guaranteed.
The product(s) will be delivered to you directly by the delivery Partner(s) (Carriers).
In certain circumstances, our delivery partner (Carrier) may provide optional services for delivering your order, such as: (a) no-signature release: opting out of providing a signature upon delivery; (b) neighbor, reception, or security delivery: redirecting delivery to a neighbor, reception, or security; (c) rescheduling a new delivery date: selecting a delivery date that suits you best; and/or (d) redirecting to a pickup point: collecting your package at a nearby pickup point. By selecting any of these services, including through any default preferences you may have selected with our delivery partner (Carrier) separately, you acknowledge and agree that Your Natural Beauty will not be responsible for any loss or damage that may result from delivering your order in this manner.

There are restrictions on some products for certain international destinations, so carefully review the information on that page before placing an order.
If you purchase products for delivery to an international destination, your order may be subject to import duties and taxes that are applied when the order arrives at that destination. Refer to section 7 (b) (above) for more information about duties and taxes. You must comply with all applicable laws and regulations of the country for which the products are intended. We are not responsible if you violate any of these laws.

Cancellation according to the Consumer Contracts Regulations.
Depending on the delivery location, you have the legal right to cancel your order. This means that, during a certain period, in the case of the European Union, it's 14 days, if you change your mind or for any other reason decide that you do not want to keep the purchased products, you can cancel the order, provided that you communicate this decision to Your Natural Beauty within a maximum of 14 days and return the product(s).
Note that Your Natural Beauty imposes certain restrictions, such as not opening, examining, or using the goods, to have the right to cancel.

Once the products have been returned to the relevant Partner, you will receive a full refund, excluding the original delivery costs; you will also be responsible for paying the return expenses to the Partner.
How to cancel according to the CCRs: Except for certain types of products as set forth in the Return Policy, you can cancel a contract at any time before the delivery of your order and within 14 days after receiving the products ("cooling-off period").
To cancel a contract, you must clearly inform, preferably:
- By completing and returning the cancellation form and sending it to the address indicated in it;
- By email: providing the name, address, order reference.
If you cancel an order (or part of an order) during the cooling-off period, you must return the product(s) within 14 days after the day on which you notified Your Natural Beauty of the cancellation and ensure that the items comply with the conditions of our Return Policy.
If you cancel the contract within the 14-day cooling-off period, we will process the due refund as soon as possible. In any case, your refund will be completed within 14 days after the day the Partner received your return or, if earlier, the day we receive proof that you returned the product(s) to the address of the selected Partner.
You will have to bear the full cost of returning the product(s) to the Partner.

This section sets forth the rules that apply to the use of the Website (whether you use it to request products or simply to browse). By using the site, you agree to these rules. If you do not agree to these rules, you are not allowed to use the site and should leave it immediately.
(a) Access to the Site: The Site is provided for free, and it is your responsibility to ensure access to the Site. You are also responsible for ensuring that all individuals accessing the Site through your internet connection are aware of these Terms and Conditions and comply with them.

Your Natural Beauty reserves the right to withdraw or alter the site without prior notice, and we may restrict access to all or part of the site from time to time. We will not be responsible if the site is unavailable for any reason at any given time or for any period.
When you visit the site and/or submit an order, you are communicating with Your Natural Beauty electronically and agree that all agreements, notices, disclosures, and other communications that we send electronically (whether on our behalf or on behalf of Partners) satisfy any legal requirement that such communications be in writing.
(b) Conduct: The use of the website for illegal purposes or any other purposes that could be deemed inconsistent with the image of Your Natural Beauty is expressly prohibited.
Unauthorized use, counterfeiting, exploitation of usurped or counterfeited content, illegitimate identification, and unfair competition are subject to criminal punishment.
Users are also prohibited from creating or introducing any viruses or programs into these sites that may damage or contaminate them, or advising third parties to do so.
Offenders will be subject to criminal proceedings.
You should also not use the site in a way that interrupts, damages, or impairs the site or its access in any way.
You must understand that you are responsible for all electronic communications and content sent from your computer to Your Natural Beauty and should use the Site only for legal purposes.
Your Natural Beauty, in compliance with any applicable law or public order, will report any violation to the relevant law enforcement authorities and will fully cooperate with any competent law enforcement authorities or court orders requesting or ordering Your Natural Beauty to disclose the identity or assist in identifying or locating anyone transmitting such content.
If you violate any of the Terms and Conditions and/or any terms and conditions of Third-Party Products and Services, you are obligated to fully indemnify all costs, expenses, liabilities, damages, and losses (including any indirect, incidental, or consequential losses), including any interest, fines, and legal fees or other professional fees and expenses awarded or incurred or paid by us and/or any member of our group as a result of or in connection with your violation.
(c) Third-Party Products and Services on the Site: The Site may contain services and/or products (including add-ons and applications) offered by third parties who are not our Partners (the "Third-Party Products and Services"). Your Natural Beauty hereby disclaims any liability or obligation related to the use of any third-party products and services.
Your Natural Beauty reserves the right to suspend, withdraw, terminate, and/or alter your access to the sites and/or services, including, but not limited to, third-party products and services, in case of violating any terms of third-party products and services.
Regarding third-party services, products, and services, it will be the responsibility of third parties to have any resources on the site, which will operate on a specific device, so Your Natural Beauty does not offer any warranty of operation.
(d) Linking: Your Natural Beauty is pleased to create a link to our site; however, you must do so fairly and legally and not damage our reputation or take advantage of it (such as using a link to suggest any form of association or endorsement). Your Natural Beauty reserves the right to withdraw link permission at any time, and if we instruct you to remove a link from the site, you must do so promptly and within a maximum of 24 hours.

Waiver - If you violate these Terms and Conditions and we do not take action, or if we delay in taking action, it does not mean that we waive our rights. If we waive a violation of yours, we will only do so in writing (signed by one of our Directors), which does not mean that we will automatically waive any subsequent violation on your part.
Entire Agreement - These Terms and Conditions constitute the entire agreement between you and Your Natural Beauty and supersede all previous agreements.
Events Beyond Our Control - Your Natural Beauty and Partners are not responsible for any failure in performance or delay in the performance of any of our obligations towards you if such failure or delay is caused by an event beyond our control, such as acts of God, wars, terrorist attacks, embargoes, riots, strikes, lockouts, trade disputes, fires, floods, earthquakes, or other natural disasters, breakdowns, bad weather, transportation disruptions, government action, or failure of public or private telecommunications or transportation networks.
If such an event occurs and affects the performance of our obligations or the obligations of Partners towards you: (i) we will contact you as soon as reasonably possible to notify you; and (ii) our obligations and those of Partners towards you will be suspended during the event. When the event affects the delivery of products, we will contact you to arrange a new delivery date after the event has ended.
Complaints - We operate a complaints handling procedure that we will use to try to resolve disputes. Please let us know if you have any complaints or comments. Refer to our contact page for details on how to get in touch with us.
Any matter related to your order, use of the sites, or these Terms and Conditions are governed by Portuguese law. The courts of Portugal will have exclusive jurisdiction over any dispute or claim related to these Terms and Conditions.
